[Pool name] private hire conditions

1. Contract of hire

The contract is between [Operator legal name] and the lead person making the booking, who must be 18 or over. Unauthorised use of the facilities is not allowed. Every booking is accepted on the basis that all visitors agree to follow these conditions.

2. Safety and supervision

There is no lifeguard on duty. [CCTV is installed for safety and security. It is not actively monitored and must not be relied on for supervision or emergency help.] Use of the pool is at the user's own risk, subject to our legal duties.

The Group Leader is responsible for the safety and first aid needs of their group for the whole hire. They must stay present, must not leave children unattended and must carry a mobile phone to call the emergency services if needed. All users must follow the Pool Safety Operating Procedure, which forms part of this agreement.

A competent adult swimmer, able to help in an emergency, must be present whenever children are in the pool. The pool is not supervised or routinely attended by staff.

Pool operating instructions, including emergency procedures, are on the notice board.

Maximum [number] swimmers in the pool at any time. No diving: maximum depth is [1.2m].

Do not swim with a contagious illness. Report all accidents and incidents to us straight away so they can be recorded.

No access to the plant room or storage areas.

3. Health, hygiene and use of facilities

No food, alcohol or glass on the premises. No smoking in or around the facility.

Children under [4], or any child at risk of a toilet accident, must wear a disposable swim nappy and a neoprene over-nappy. If contamination occurs, the session may end and cleaning or closure costs may be charged. Take used nappies home.

Shower before entering the pool. No outdoor footwear in the changing rooms or on the poolside.

Leave the premises as you find them. Your session includes changing time; overstaying may be charged.

[Please keep noise down for our neighbours and park only in the allocated spaces.]

4. Loss, injury and liability

The Group Leader is responsible for the supervision, safety and behaviour of their party during the hire.

We are not responsible for loss, theft or damage to belongings, except where caused by our negligence or breach of legal duty.

Nothing in these conditions excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot legally be excluded.

5. Booking, refunds and membership

Only people aged 18 or over may book. The person booking is the Group Leader and must make sure their party follows these conditions, the Code of Conduct and the Pool Safety Operating Procedure.

[A valid membership is required to book. Memberships are non-refundable once active but can be cancelled at any time; members can keep booking until the end of their current period.]

Bookings can be rescheduled up to [48] hours before the start time, subject to availability. Requests made later will not normally be refunded or moved, as the slot may not be refilled at short notice.

We may cancel or rearrange a session for safety, water quality, plant or equipment failure, emergencies, staff availability, breach of these conditions, non-payment, or events outside our control. If we cancel and it is not due to your breach, we will offer a new session, credit or refund.

6. Lone swimming

Lone swimming is not allowed. At least two people must be present, one of them the Group Leader. Children must never be left unattended in the pool or pool building.

7. Damage and subletting

The hirer is responsible for damage caused by their party. We may recover the reasonable cost of repair, replacement or cleaning, and any direct loss of earnings if the facility cannot be used.

Bookings are for the hirer's own use and must not be sub-let, transferred or sold without our agreement.

8. General

By booking you agree to these conditions. Questions: [email].

In an emergency, call 999. [Out-of-hours contact: method]

How to adapt it

  • No membership model: delete the membership paragraph in section 5.
  • Lifeguarded hire: replace section 2's supervision text with your lifeguard arrangements.
  • Set the swimmer limit from your bathing load record, not from this template.
  • Change the 48-hour reschedule window to suit how quickly you can refill a slot.

Questions

Can I rent out my pool without a lifeguard?

Many private pools do, with a Group Leader responsible for supervision and a written operating procedure. Check your insurer's conditions first.

How many people can swim in my pool at once?

Work it out from the pool area and the type of use. Our bather load calculator walks you through it.

Can I exclude liability for injuries?

No. You cannot exclude liability for death or personal injury caused by negligence. Section 4 says so.
