[School name] terms and conditions

1. Responsibilities and supervision

The contract is between [School legal name] and the parent, guardian or account holder accepting these terms and conditions.

Swimming teachers are responsible for participants only during the scheduled lesson. The lesson begins when the teacher accepts charge of participants and ends at the close of the lesson.

Parents and guardians are responsible for supervising their children at all other times, including in the changing rooms. All children must be accompanied by a parent or guardian in the changing area.

Parents and guardians must not leave the premises during lessons.

2. Use of facilities

[Parking is available on site. Vehicles are parked at the owner's risk and we accept no responsibility for loss or damage.]

Please arrive no more than [15] minutes before the lesson and leave within [15] minutes afterwards, to keep the changing rooms comfortable.

Swimmers must not enter the water before the lesson unless invited and supervised by a swimming teacher.

3. Health, safety and behaviour

All swimmers must wear a swim cap. If a swimmer does not have one, we will provide one at a charge of [£8].

Parents and guardians must not distract teachers during lessons.

All customers must follow our pool procedures, Pool Safety Operating Procedure, Safeguarding Policy, Poolside Rules, booking instructions and any poolside notices in force at the time.

4. Photography and privacy

Parents, guardians, swimmers and visitors must not take photographs or videos in the changing rooms or on the poolside. We only take or use photographs or videos of children where appropriate consent has been given, in line with our Safeguarding Policy and Privacy Notice.

5. Payments and refunds

We do not store any bank or card details.

Once your account is created and these terms are accepted, a binding contract exists between you and [School name].

Fees for the full term are due in advance, as shown on your invoice.

Refunds are not normally given once the term has started, as fees secure the swimmer's place for the full term. Any refund or credit is at the discretion of management and where required by law. Approved refunds may carry a [£10] administration charge, unless the refund is because we cancelled a lesson or course.

6. Cancellations and non-attendance

If a swimmer misses a lesson for sickness, holiday or any other reason, no refund or credit is given, as payment secures the place for the full term.

We may cancel any lesson or course. Affected swimmers will be credited for the missed session, usually against the next term's fees. Where that is not possible or suitable, we may offer another arrangement or a refund.

You must give at least [14] days' written notice before the end of the current term if you do not wish to continue. Without notice, fees for the following term will be due.

Send cancellation notices in writing to [email].

7. Your right to cancel

If you book online, you can cancel within 14 days of accepting these terms without giving a reason. If you ask for lessons to start within those 14 days and then cancel, we will refund what you paid less the cost of lessons already given. To cancel, email [email]. After the 14 days, section 6 applies.

How to adapt it

  • Monthly billing: replace termly fees and notice with a monthly rolling Direct Debit and one month's notice.
  • No parking on site: delete the parking sentence in section 2.
  • Set your own cap charge and refund admin fee, or remove them.
  • Other activities: the structure works for dance, gymnastics or martial arts with the swim-specific lines changed.

Questions

Do swim schools need terms and conditions?

Yes. They set out what parents are paying for, who is responsible for children when, and how cancellations work. Having parents accept them at registration avoids most fee disputes.

Do I have to offer a 14-day cooling-off period?

For bookings made online or at a distance with consumers, the Consumer Contracts Regulations usually give a 14-day right to cancel. Section 7 covers it. Check with a solicitor for your setup.

Can I refuse refunds for missed lessons?

Many schools do, because the fee secures a place for the whole term. Say so clearly before parents book, as section 6 does.
